Terms and conditions

Variation of courses by Biviwacker

By its very nature a Biviwacker course is subject to natural forces and although every effort is made to comply with the course content, Biviwacker reserves the right to alter the course content to match any natural variables. The client acknowledges that information provided by us is given to the best of our ability but because of natural variations in may be necessary to change the itinerary and that in such circumstances it is not reasonable to expect Biviwacker to be liable for any losses as a result, and that our liability is limited accordingly.

Client conduct

Biviwacker clients are expected to behave in a reasonable manner at all times and to comply with the instructions and leadership of Biviwacker instructors. Biviwacker reserves the right to remove any client(s) from the course at the discression of the instructor/leader without recourse to repayment for that course and against the client(s) will if necessary. Circumstances that may warrant exclusion from a course includes, (without limitation) intoxication, use of non prescribed drugs, abusive behaviour, inability to meet the rigours of the course for physical or mental reasons, or through lack of appropriate equipment. If you are in any doubt about your ability to meet the rigours of the course, please contact you GP before booking. For removal of any party under such conditions Biviwacker will not be liable for any losses as a result and Biviwacker is also entitled to any reasonable costs arising from removal of said client(s) payable upon demand.

Insurance

Biviwacker is covered to a level of £5,000,000 for public liability and is insured as an outdoor activity provider. Biviwacker clients are advised to provide their own personal insurance cover from an established company. Please take note of conditions in your policy with regard to ‘hazardous activities’ and ‘working with hand tools’.

Payment & Cancellation of courses

A booking will be deemed confirmed upon receipt of a completed booking form and a 50% deposit per participant. Due to the substantial preparation that goes into any course the client should be aware that this deposit is non-refundable should the client for whatever reason decide not to attend the course. Final payment of the account should be made 14 days before the event. Please note that the final payment is also non-refundable should cancellation by the client occur.

Liability

Biviwacker courses take place in the outdoors and in a woodland environment, which by its nature is never completely free from hazard. While all reasonable precautions are taken to minimize the risks the client accepts that accidents including serious injury and death can occur without Biviwacker being at fault. The client also recognizes that Biviwacker is not responsible for the loss or damage to the personal property of the client, including vehicles, money, clothing and or equipment. The client also recognizes attendance of a Biviwacker course in no way qualifies him/her to teach the course content. Biviwacker therefore accepts no responsibility for any mishap occurring to third parties taught by attendees of any Biviwacker course. Biviwacker also takes no responsibility for any mishap during the course from any instruction or information not given by a Biviwacker appointed instructors or assistants. Biviwacker also takes no responsibility for any mishaps occurring as a result of the client failure to follow instruction. Biviwacker will only accept liability for physical injury to a client that is shown to result from negligence on the part of Biviwacker.

Repairs

Individuals are liable for the cost of and repairs made necessary by willful damage to equipment or to the landowner’s property.

Complaints

In the unlikely event that a client has cause for complaint about a Biviwacker course, the complaint should be made to a representative of Biviwacker during the event in order that corrective action can be taken if necessary. If the complaint is about a member of staff please contact the office and we shall inform you of the complaints procedures so we can take necessary action. Any complaint must be made immediately. Biviwacker will not accept a complaint after the end of the course. However, should a problem not be resolved at source, a complaint should be made in writing within 28 days or this complaint will not be upheld.

Cancellation by Biviwacker

In the unlikely event that Biviwacker cancels a course, all monies will be refunded in full, or if preferred, transferred as a deposit for another course.


Summary

All Biviwacker courses are designed to be as safe as possible. However you will be in a woodland environment, cooking on open fires. It is therefore quite possible to burn, stain or otherwise damage your equipment and or clothes. Minor cuts and bruises are also possible due to the very nature of the activities. Please do inform us if you have any medical condition that will affect your ability to participate.
